What does USCIS require for certified translations?

Under 8 CFR § 103.2(b)(3), any document submitted to USCIS that is not in English must be accompanied by a complete English translation. The translator must certify that the translation is accurate and complete, and that they are competent to translate from the source language into English. USCIS does not require that the translator be an ATA-certified member, but using an ATA-certified translator is the clearest way to demonstrate competence. The certification must include the translator's full name, signature, and date. Our Certificate of Accuracy meets all of these requirements.

What USCIS forms require translated documents?

Virtually every USCIS form that involves a foreign-born applicant requires certified translations of supporting documents. I-130 family petitions require birth and marriage certificates. I-485 adjustment of status requires birth certificates, marriage certificates, police clearances, and financial records. N-400 naturalization requires foreign birth records and any court or criminal records. K-1 fiancé visa petitions require the foreign national's personal civil documents. Asylum applications require personal statement evidence and country condition documentation. I-864 affidavit of support submissions may require financial document translations.

Will my application be rejected if the translation doesn't include a certification?

Yes — submitting an uncertified translation or a translation with an improper certification is grounds for a Request for Evidence (RFE) or denial. USCIS adjudicators are specifically trained to check translations for compliance with 8 CFR § 103.2(b)(3). An improperly certified translation does not count as a certified translation under the regulation. This is a common cause of RFEs for pro se applicants who use online translation services without understanding the certification requirement.
